This website concerns settlement of an employee class action lawsuit (the “Action”) against FN Logistics, LLC (“FNL”) for alleged wage and hour violations.
If you already received mailed notice about the Action, you do not need to do anything to be part of the “Settlement Class” (as defined below) and to receive payment. However, another copy of the Notice you should have received and describing your options is posted on the Important Documents page. You can also get more information from the other documents posted there. Key dates are posted on the Important Dates page. Consult the Contact page if you want more information.
If you did not receive a mailed copy of the Notice, you are still eligible to receive payment and be part of the settlement, if you establish that you are within the Settlement Class, as defined below. However, in that case, in order to participate in the settlement and potentially receive payment, you will need to fill out and file the Claim Form located on the Claim Form page. You have only until October 26, 2026, to submit a Claim Form.
If you are in the Settlement Class, and do not submit a Claim Form, you will not receive any payment but will be deemed to have released the “Released Claims” as described and defined in the Notice posted under the “Important Documents” tab. If you are in the Settlement Class and submit a timely and approved Claim Form, you may also file an objection by October 26, 2026. You will find information about how to file an objection in Question 9. If you file a timely and approved Claim Form and also submit an objection, you will be bound by the settlement in whatever form approved by the Court and whether or not the Court accepts your objection. Finally, if you are within the definition of the Settlement Class, and submit a timely and approved Claim Form, you may opt out of the class portion of the Settlement by submitting a proper Request for Exclusion by December 1, 2026. If you submit a timely and approved Claim Form and a timely and proper Request for Exclusion, you will be bound by the PAGA portion of the Settlement and be eligible for an individual PAGA Payment and will preserve your non-PAGA claims, as described in the Notice. Please note that your Claim Form is subject to review and approval to confirm that you are in fact in the Settlement Class. Even if you submit a Claim Form, it may be determined that you are not within the Settlement Class. Again, consult the Contact page if you want more information.
The “Settlement Class” consists of all current and former hourly, non-exempt employees who worked for FN Logistics LLC or its predecessor FN Logistics, Inc. in California at any time from January 13, 2019, through December 31, 2024 (the “Class Period”), as well as any and all temporary employees who worked for Defendant or its predecessor at any of their California locations during the Class Period and who were hired or placed through any temporary or staffing agencies. The Settlement Class includes, but is not limited to, temporary workers from the following temporary or staffing agencies: Adecco, Bluecrew, Personal HR, Randstad, Next Level Staffing, IWC, Compliant Care Staffing, Driven Talent, and Eastridge.
